Negotiations on labour reform continue to face significant challenges, despite progress in several areas, with key disagreements persisting between the Government, trade unions and employers’ confederations.
In an article published in Human Resources, Carlos de Oliveira Sarmento, Managing Associate in the Labour practice at CCA Law Firm, analyses the current state of negotiations, highlighting the main points of contention, including individual working time accounts, the reinstatement regime in cases of unlawful dismissal, fixed-term employment contracts and the outsourcing framework.
In this context, he notes that “we believe the reform will move forward and that things will not remain unchanged, but it is also unlikely that there will be a break with the status quo as initially presented to the country”.
The article further highlights that, despite the lack of agreement within the Social Concertation framework, the Government is expected to move forward with a legislative proposal, leaving open the balance between labour market flexibility and worker protection.
