Did you know that poor management of employees’ annual leave can lead to fines and significant costs for companies?

In an opinion article for RH Magazine, Carolina Hecker, Principal Associate in the Labour practice at CCA Law Firm, explains the main legal obligations related to the scheduling and taking of annual leave, warning of the consequences of non-compliance — ranging from serious administrative offences to additional compensation payable to the employee.

“In the absence of an agreement, it is the Company’s responsibility to ensure compliance with the rules governing this matter, namely that annual leave is taken in the year it is accrued (thus ensuring the unilateral scheduling of the leave period). Failure to comply with these rules may constitute a serious administrative offence and may also require payment of compensation to the employee amounting to no less than three times the salary corresponding to the untaken leave days,” states the lawyer.
