Catarina Limpo Serra and Marta Duarte comment on the Marega case

Catarina Limpo Serra, Coordinator of the CCA’s Litigation and Arbitration Department, and Partner Marta Duarte, Partner at CCA, in statements to ECO-Advocatus, comment on the Marega case and explain what measures could have been taken by the referee who led the match last Sunday, between Vitória de Guimarães and FC Porto. After being the target of racist chants and insults from supporters of the opposing team, FC Porto player, Marega, abandoned the match causing an interruption of approximately five minutes.

"The new FIFA Disciplinary Code allows referees to interrupt a football match due to racist incidents and they may even end the match and attribute defeat to the offending team or to its supporters. In addition, sanctions can be imposed on clubs and supporters", says Catarina Limpo Serra.

On the day following the match day, the Prosecutor’ office opened an investigation before the Department of Investigation and Penal Action (DIAP) of Guimarães. According to the Criminal Code, crimes of discrimination and incitement to hatred and violence (article 240, number 2, point b) will be at stake, with a penal framework of six months to five years of imprisonment and the crime of injury (articles 181 and 182) directed against the player himself, and sentence that can go up to three months of prison or a fine of up to 120 days, explains Marta Duarte.
