Catarina Limpo Serra speaks to Observador about the judicial actions against Chic by Choice

Catarina Limpo Serra, Senior Associate of the Litigation Department at CCA ONTIER, in statements to Observador, comments on the judicial actions brought by three entities - Millennium BCP, UPS of Transports and RISA Consulting - against Chic by Choice, last year. The lawsuits were filed in the courts of the districts of Santarém and Leiria in October 2017, February 2018 and September 2018 and claim a total of 72,784 euros in debts.

Of the three lawsuits still pending, two are ordinary executive actions and one is a summary action, that of the UPS of Transports, which according to the Lawyer means that "there has already been a decision concerning the UPS action and the debt of 14,362 euros was not paid voluntarily, forcing the company to file another action to enforce the payment".

"The creditors apply to the Courts so that they can execute the assets of the debtor, that is, to proceed with the seizure of assets that are in the name of the company or the entrepreneurs, if they have given personal guarantees at the time they signed the contracts. After this action goes to court, an enforcement agent is appointed, who can then pawn the goods and sell them in the scope of the judicial process", explains Catarina Limpo Serra.
