The promotion of unlicensed online casinos through digital influencers has been gaining visibility, reaching millions of followers and raising significant legal issues in the areas of advertising law, unlawful gambling operations and regulatory liability.
In an article published in Público, Filipe Mayer, partner at CCA Law Firm, analyses the legal framework applicable to the promotion of online gambling platforms not authorised to operate in Portugal, highlighting that influencers may face legal consequences even when operating from outside Portuguese territory.
As he states: “Já o Código da Publicidade é claro ao definir que a publicidade que estimule ou faça apelo a uma actividade ilegal ou criminosa é proibida, sendo punido como agente de uma contra-ordenação qualquer interveniente nessa mensagem publicitária, entre eles, também, os influenciadores”
He further notes that Portuguese law provides for the liability of all parties involved in an advertising message, reinforcing the need for strict compliance with the rules governing gambling advertising and digital promotional activities.
