Henrique Mota de Sousa comments on possible liabilities in the Elevador da Glória accident

The accident involving the Elevador da Glória, in Lisbon, which resulted in 16 deaths and several injuries, has raised multiple legal questions, particularly regarding the determination of civil and criminal liability. The case is being investigated by several entities, including the Public Prosecutor’s Office, the Judicial Police, and the Office for the Prevention and Investigation of Aircraft and Railway Accidents (GPIAAF).

In a comment to Observador, Henrique Mota de Sousa, Coordinating Associate in the Insurance and Reinsurance practice at CCA Law Firm, highlighted the complexity of the investigative process and the need for time to determine whether or not there will be criminal liability in the case.

“In this case, there are a number of variables that we are unaware of; it is an accident that will involve several expert assessments and criminal investigation reports. There are a series of procedures that take place in incidents of this nature, which will then conclude whether or not criminal liability exists and whether there will be one or more entities liable from a criminal standpoint.”

According to the lawyer, only after the completion of the expert assessments and technical reports will it be possible to determine any criminal responsibility, while the civil aspect already points to the obligation to compensate the victims.
