The draft new Tariff Regulation for Water Services, put out for public consultation by ERSAR, introduces significant changes to how system costs are reflected in the tariffs charged to users.

In an article published in Jornal Água & Ambiente, Joana Freitas Peixoto, Principal Associate in the Public Law practice area at CCA Law Firm, analyses the proposed model, highlighting the introduction of a common methodology for tariff setting, based on the concept of the revenue required to ensure the economically sustainable operation of water systems.

In this context, she notes that “it is important to bear in mind a key point: the regulation harmonises the methodology for calculating tariffs, but does not standardise them.”

The article further highlights that, despite enhanced transparency and predictability, tariffs will continue to vary across systems depending on their cost structures, with ongoing challenges remaining in terms of financial sustainability, affordability and the overall organisation of the sector.
