The debate over the boundaries of humor has resurfaced following the legal dispute between singers Nelson and Sérgio Rosado (known as Anjos) and comedian Joana Marques. At the heart of the controversy is a video published as part of the segment “Extremamente Desagradável” (“Extremely Unpleasant”), which is now the subject of legal proceedings alleging a violation of personality rights.
In an opinion piece published by CNN Portugal, Maria Madalena de Azeredo Perdigão, Senior Associate in the Litigation and Arbitration department at CCA Law Firm, provides a legal analysis of the case. She explores the balance between freedom of expression and the protection of honor, framing the issue within both national and international jurisprudence.
“It is well-established jurisprudence—both nationally and internationally—that freedom of expression applies not only to innocuous ideas but also to those that shock or disturb. Perhaps especially to those,” the lawyer emphasizes.
Maria Madalena de Azeredo Perdigão argues that the satirical content in question falls within the legitimate exercise of freedom of expression and artistic critique, as it targets the public performance of the singers as media figures without crossing the threshold into personal offense.
