Why does the majority of the more than €600 million available in the Labour Compensation Fund remain unclaimed?

In an article for ECO, Pedro Antunes, Partner in the Labour practice at CCA Law Firm, examines the main obstacles companies have faced in trying to access the amounts accumulated since the fund’s inception — which only became available for withdrawal as of February 2023.

“The system only allows submission of Excel files if all entries include decimal points, which is not always intuitive for users. In many cases, the amount to be requested would be, for example, five thousand euros, but the system requires the figure to be entered as €5,000.01 — making the process invalid without any clear explanation,” explains Pedro Antunes.

According to the lawyer, unintuitive technical requirements, lengthy processing times, and the strict legal limitations on eligible uses are among the factors that may hinder effective access to the fund before the deadline in December 2026.
