The use of Artificial Intelligence (AI) in Human Resources is transforming people management, but it also raises serious legal challenges.
In an opinion article for RH Magazine, Pedro Antunes, Partner in the Labour practice at CCA Law Firm, highlights the importance of responsible application of AI in compliance with the General Data Protection Regulation (GDPR) and the new rules of the AI Act.
Pedro Antunes also warns that failure to comply with these obligations can result in fines of up to 7% of annual turnover. Legal compliance and ongoing training for HR professionals are essential for the safe and ethical use of AI.
‘The requirement for transparency and the right to appeal reinforces the need for companies to implement responsible practices in the use of AI, minimising the risk of discrimination or unfair decisions, while ensuring employee confidence in the technologies applied to HR processes,’ explains the lawyer.
