The Government’s proposal to revise the Labour Code brings the issue of labour flexibility back to the forefront. Among the measures under discussion are changes to strike regulations, outsourcing rules, and holiday management — all with a direct impact on how companies organise their human resources.
In an article published in Trabalho by ECO, Pedro Antunes, Partner, and Sofia Carneiro Silva, Labour Associate, analyse some of the proposals under discussion, namely the possibility of negotiating additional holiday days by mutual agreement between employer and employee, and the removal of restrictions on outsourcing following dismissals.
“The Labour Code does not expressly prohibit the possibility of granting additional holiday days by agreement, provided that: the minimum legal period is not reduced; there is voluntary agreement between employer and employee; and the principles of equality and non-discrimination are respected.”
