Henrique Salinas, Partner of the Criminal Department at CCA ONTIER, wrote an opinion piece for Expresso wherein he comments on the 'e-toupeira' case and reinforces the importance of compliance programs, whose main objective is to prevent the practice of conduct that may constitute crimes.
"It is still too early to anticipate whether this criterion will be considered adequate and sufficient, in court, for the attribution of these behaviors to the legal person, but the use of non compliance programs for this purpose is the final proof of its fundamental importance for any company that does not want to be involved in processes of this nature", emphasizes Henrique Salinas.
