The allocation of cars to employees continues to be a common practice in many companies, especially when the exercise of professional duties justifies it. However, its use - whether exclusively professional or also personal - often raises doubts about its legality, tax framework and the need for internal regulation.
In an article for RH Magazine, Maria Luís Guedes de Carvalho, Senior Associate in the Labour practice at CCA Law Firm, explains the importance of a clear policy on the allocation and use of cars. Maria Luís emphasises that, as well as ensuring compliance with legal obligations, these policies promote equality between employees and avoid potential conflicts or abuses.
The definition of eligibility criteria, the distinction between professional and personal use, cost management, liability for fines or accidents and environmental impact are just some of the points that should be covered. These policies should also be periodically reviewed and accompanied by the signing of a statement of liability by the employees concerned.
‘A good policy on the allocation and use of vehicles should therefore, rather than imposing rules, match expectations, protecting all parties involved and reducing any possible conflicts,’ she explains.
