With the repeal of the most restrictive measures from the “More Housing” package, the Short-Term Rental (STR) sector in Portugal has entered a new phase, now characterised by greater municipal autonomy. Municipalities have been granted freedom to define the rules for operating STRs within their territories—a decentralisation that, although well-intentioned, raises new concerns regarding the security and predictability of the regulatory framework.
In an article for The Portugal News, Maria do Rosário Tavares de Pina, Associate in the Real Estate practice at CCA Law Firm, warns of the risks posed by legislative fragmentation and the absence of common criteria to guide the actions of various municipalities.
“Short-Term Rentals are entering a new phase marked by greater local autonomy but also renewed uncertainties. Decentralisation, if not accompanied by clear guiding principles and national coherence, may become fertile ground for reactive and uncoordinated decisions,” explains the lawyer.
