The Liberal Initiative’s proposal to reform Portugal’s labour legislation has once again brought issues such as merit, labour market flexibility and employee protection to the centre of the debate.
In an article published in RH Magazine, Pedro Antunes, Partner in the Labour practice area at CCA Law Firm, analyses some of the most significant measures included in the proposal, particularly the introduction of a dismissal mechanism based on repeated underperformance, the revision of the reinstatement regime in cases of unlawful dismissal, the strengthening of parental rights and changes to the organisation of working time.
In this context, he notes that “a culture of merit, both in rewarding performance and enabling transparent dismissal processes, may be central to achieving the level of labour market flexibility that Portugal requires.”
The article also reflects on the practical challenges associated with implementing these measures and on organisations’ ability to balance greater flexibility in workforce management with the need to safeguard employees’ rights and protections.
