The labour reform proposal presented by the Government continues to raise debate regarding the impact that some of the proposed measures may also have on the Public Administration, particularly due to the references made by the General Labour Law in Public Functions to the Labour Code.

In an article published in ECO, Pedro Antunes, partner in the Labour practice at CCA Law Firm, analyses the potential effects of the proposal on matters such as individual working time accounts, remote working, fixed-term contracts and parental rights.

In this context, the lawyer notes that “what this proposal does is not to immediately amend the General Labour Law in Public Functions, but rather to create a new benchmark. And that ultimately has consequences, whether through legal cross-reference mechanisms or future political choices”.

The analysis further highlights that, although several of the proposed changes would not automatically apply to public employment, legislative practice in Portugal has traditionally been marked by a gradual alignment between the private labour regime and the framework applicable to Public Administration employees.
