Rodrigo Volz Correia comments on the agreement between the State and the Lisbon City Council for the future headquarters of the Academia de Amadores de Música

The inclusion of the building on Avenida de Berna, intended to house the future headquarters of the Academia de Amadores de Música, on the list of properties to be sold by the State does not jeopardise the agreement between ESTAMO and the Lisbon City Council.

In an article for Observador, Rodrigo Volz Correia, Senior Associate in the Public Law practice at CCA Law Firm, explains that “the resolution of the Council of Ministers merely defines the conditions for the sale of the listed properties, without retroactively interfering with prior negotiations”.

The lawyer adds that the municipality retains legal leeway to complete the purchase, since the Legal Regime of Public Real Estate allows public sector entities to directly acquire property from the State. Even so, the transaction may require additional authorisation from the Government, which establishes the need for a Prime Ministerial order for the disposal of public assets.
