In an increasingly scrutinised employment landscape, employers face a challenge that goes beyond legal compliance: they must be able to demonstrate, objectively and consistently, the criteria underpinning their decisions.
In an article published in RH Magazine, Sofia Carneiro Silva, Associate in the Labour practice area at CCA Law Firm, examines the growing importance of properly substantiating and documenting employment decisions, addressing topics such as performance appraisals, bonus schemes, dismissals, pay transparency, the use of artificial intelligence in recruitment and hybrid working models.
In this context, she notes that “In an increasingly scrutinised employment relationship, making the right decision is no longer enough. Employers must be able to demonstrate how and why that decision was made.”
The article highlights that the ability to establish clear criteria, ensure consistency in decision-making and justify employment decisions in a transparent manner has become a key factor in mitigating employment risk and supporting the long-term sustainability of organisational decisions.
