Where does an engaging digital experience end and a design architecture intended to make it harder for users to disengage from a platform begin?

In an article published in SAPO, Ana Beatriz Bravo, Associate in the TMT practice at CCA Law Firm, draws on the recent case involving Meta in the United States to examine the legal questions surrounding the way digital platforms are designed to capture and retain users’ attention, particularly that of children and teenagers.

The article explores the relationship between design, personalisation and individual autonomy, as well as the need to distinguish transparency from genuine control over our choices. In this context, Ana Beatriz Bravo notes that “information is not the same as control”.

The article also considers the European response to these challenges, particularly through the Digital Services Act (DSA), and discusses the limits that may be imposed on design practices capable of influencing users’ decisions, especially where minors are concerned.
