Andreia Morgado Duarte highlights risk of rights violations under new family reunification law

The recent amendments to Portugal’s Immigration Law, announced by the Government, introduce stricter conditions for family reunification involving foreign citizens holding residence permits. The proposal includes requirements such as a minimum length of residence, adequate housing, and the exclusion of social benefits from the calculation of means of subsistence. These changes have raised significant concerns regarding their practical implications and impact on fundamental rights.

In an interview for the Público Brasil, Andreia Morgado Duarte, Senior Associate in the Private Clients practice area at CCA Law Firm, warns of the consequences of this legislative shift and stresses the importance of ensuring legal protection for individuals already living in Portugal.

"If this situation is not properly addressed by the Government, we will be facing a violation of citizens’ rights, freedoms and guarantees. The fact that someone does not hold legal documentation cannot justify the disregard for their rights without any form of protection. I believe the Government will carefully consider the proposal it will submit to Parliament" said the lawyer.

According to Andreia Morgado Duarte, the absence of a transitional regime or clear safeguards for individuals already residing in Portugal may increase legal uncertainty for migrant families and undermine fundamental rights protected by both Portuguese and European law.
